The sales and use tax landscape is shifting dramatically, and with it the tax collection responsibility for online sales, in the wake of the landmark Supreme Court sales tax decision in South Dakota v. Wayfair Inc. With the bright line test of physical presence now expanded, states are free to implement sales tax collection laws and rules based on the much broader standard of economic presence, and they are rushing to put laws and regulations in place expanding their taxing authority.
